What is the EU–US Data Privacy Framework?

It is the EU's agreement with the US that lets personal data go to US companies that sign up to it. Those companies certify with the US Department of Commerce and appear on a public list at dataprivacyframework.gov. A vendor on the list can receive EU data without extra transfer contracts.

Is the EU–US Data Privacy Framework still valid?

Yes. The European Commission adopted it in July 2023, and the EU General Court upheld it in September 2025. Further court challenges remain possible, which is why many vendors also keep standard contractual clauses in their DPA.

Do EU vendors need the framework?

No. The framework covers transfers to the US. A vendor based in the EU, or in a country the EU considers adequate such as the UK, Switzerland or Japan, doesn't need it. Its own sub-processors in the US still might.
